Terms of Service

These are the rules for using WavePlay. We have written them to describe what the platform actually does rather than to cover every imaginable eventuality — if a rule is stated here, something in the product enforces it. Using WavePlay means you accept these terms.

Who we are

WavePlay is an independently operated video streaming platform based in India, reachable at waveplay.in. In these terms, “we” and “WavePlay” mean the operator of that service, and “you” means the person using it.

Everything reaches one address: contact@waveplay.in. How we handle your personal data is set out separately in Privacy & Safety, which forms part of these terms.

Who can use WavePlay

You must be 18 or older. This is enforced at signup from the date of birth you provide, and it is not a formality we are willing to look past.

The reason is specific. The Digital Personal Data Protection Act, 2023 treats anyone under eighteen as a child and requires verifiable parental consent before their data may be processed. A tick-box does not satisfy that. Rather than pretend otherwise, WavePlay is an adults-only service.

A small number of accounts were created before this rule and may belong to people under eighteen. Those accounts keep their protections: no watch history is recorded for them, they are excluded from recommendation profiling, and they do not appear in age or gender statistics.

Your account

  • One person, one account. You are responsible for what happens under it, so keep your password to yourself.
  • Give us accurate details. Recovery depends on your email address being real and reachable; we cannot restore an account we have no way to verify.
  • Your channel name must be unique, compared ignoring capitals and spaces. Your @username is a separate, permanent identifier used in links.
  • Channel names are not property. If a name is used to impersonate a person or organisation, we may change it. If we do, we will email you and say why, and the change is recorded on the account. Your username, your videos and your sign-in are untouched.
  • We do not sell verification, and a verified badge is never a comment on the quality of anyone's videos.

Your content stays yours

You keep ownership of everything you upload. We claim no ownership of your videos, thumbnails, descriptions or comments.

To actually show your video to anyone, we need your permission to do the mechanical things a video platform does: store the file, convert it to other qualities, generate thumbnails and subtitles, and stream it to viewers you have made it visible to. By uploading, you grant us a non-exclusive, worldwide, royalty-free licence to do exactly those things, and nothing beyond them. It lasts only as long as the content is on WavePlay.

We will not sell your content, license it to anyone else, or use it to advertise WavePlay without asking you first.

You are telling us, when you upload, that the content is yours or that you have permission to post it — including for any music, footage or images inside it.

Visibility is your choice

Public, unlisted and private mean what they say, and the same rule is applied everywhere a video can appear — search, recommendations, playlists, collections, series and shared links alike. A private video stays private even inside a public playlist.

What is not allowed

Do not upload, post or share:

  • Anything involving the exploitation, abuse or sexualisation of minors. This is reported to the authorities, not merely removed.
  • Content that harasses, threatens, or targets an individual.
  • Content depicting or glorifying violence, self-harm, or illegal activity.
  • Sexual content, and content designed primarily to shock or disgust.
  • Misinformation intended to mislead or cause harm.
  • Spam, scams, deceptive thumbnails or titles, or coordinated inauthentic behaviour.
  • Anything that infringes someone else's copyright, trademark or privacy.
  • Malware, or links intended to compromise other people.

Do not, in using the service:

  • Inflate your own numbers — views, likes, riders or reports — by any automated or coordinated means.
  • Submit false reports, or organise others to report someone.
  • Attempt to access an account, video or endpoint that is not yours, or probe the service for weaknesses without our written permission.
  • Scrape the platform, or place automated load on it beyond ordinary use.
  • Impersonate another person, or misrepresent a connection to one.

Found a security flaw? Tell us at contact@waveplay.in before telling anyone else, and give us a fair chance to fix it. We will not pursue anyone who reports in good faith and does not access other people's data in the process.

Moderation, and your right to reply

Anyone can report a video. Reports are weighted rather than counted — a brand-new account counts for a fraction of an established one, and a video is only hidden automatically once several established accounts have independently reported it. This is deliberate: it makes it impractical to silence someone by creating throwaway accounts.

If your video is hidden, you are told. You get a notification and an email, and you can contest it once from the video itself. We read appeals ourselves. If the reports are cleared, your video comes back with its original visibility setting intact.

We may also remove content or suspend an account directly where something is clearly illegal or dangerous. We will say why.

Uploads are checked on arrival: a file has to actually be what it claims to be, and there is a 2 GB limit per file.

PlayCoins

PlayCoins are a points feature inside WavePlay, used to tip creators. Be clear on what they are not:

  • They are not money, not a currency, and not a stored-value instrument.
  • They cannot be bought, sold, exchanged or withdrawn, and have no cash value.
  • They confer no ownership, and no right to a payment from us or anyone else.

We may adjust how PlayCoins are earned or spent as the feature develops. If we ever introduce a way to buy them, that will require its own terms, and we will not apply them retroactively to coins you already hold.

The service as it is

WavePlay is built and run by one person. We think that is a feature, but it means you should hold realistic expectations:

  • There is no uptime guarantee. The service may be unavailable for maintenance, or because something broke.
  • Features may change or be withdrawn. We will not remove something you depend on without notice where we can avoid it.
  • Keep your own copies of anything you care about. We take care with your data and we take backups, but we are not an archive, and you should not treat us as the only copy of your work.

The service is provided “as is”, without warranties of any kind, to the extent the law allows.

Ending your use

You can leave at any time, from your profile page. Here is exactly what happens:

After 30 daysPermanent. Video files are deleted from disk, and your personal details are erased from both databases. Your name and channel name are released for others to use.

One thing survives, and Privacy & Safety explains it in full: your watch-history rows are kept with the link back to you permanently destroyed, because that is what makes recommendations work for everyone else. Ask us and we will delete those too.

We may end your access if you break these terms, if your account is used to harm others, or if we are required to. Except where something is urgent or illegal, we will tell you why and give you a chance to respond.

Liability

To the extent the law allows, WavePlay is not liable for indirect or consequential loss, lost profits, or lost data arising from your use of the service.

Nothing in these terms limits liability for anything that cannot lawfully be limited — including fraud, or death or personal injury caused by negligence. If any part of these terms is found unenforceable, the rest continues to apply.

You are responsible for what you upload, and for any claim brought against us because of it.

Governing law

These terms are governed by the laws of India, and the courts of India have jurisdiction over any dispute arising from them.

None of this affects rights you have under consumer protection law that cannot be contracted away, or your right to complain to the Data Protection Board of India about how your personal data is handled — see Complaints and grievance redressal.

Changes to these terms

We will update this page as WavePlay changes, and the date at the top always reflects the current version. For anything that materially affects your rights or what you may do here, we will tell you in the app or by email rather than quietly editing the page.

If you disagree with a change, the remedy is to stop using WavePlay and, if you wish, delete your account — which you can do yourself, as described above.
